The Fair Debt Collection Act (FDCPA) protects you from these debt collection agencies illegal practices. It also lays down the rules that a collection agency has to follow wherever they go for collection. It is better to know some vital information about this law.

 

The Modus Operandi of the FDCPA

The agency can call you during normal business hours. They should not cause undue disruption of work or interruption. They should not call you late at night. If the employer does not allow them to contact you at work they should listen to him. When they meet your friends or relatives they should ask for your contact information. They cannot reveal their nature of business with you.

 

No harassing techniques are allowed in collecting debts from you. They should not be cruel, abusive, or use impolite language or engage in unprofessional acts. They should not lie or make false statements to collect debts. They must correctly give the amount of debt owed by you and correctly identify themselves to you. You owe, their claim is illegal and they want to extract more money from you.

 

According to FDCPA the collection agency is expected to help you and understand your legitimate rights. If you are not made aware of your rights or if you feel your rights are violated, you should lodge a formal complaint against the agency. In doing you should document all the conversations with the agency clearly. You are expected to keep a record of all your correspondence to back up your claim.
